Mods are allowed to do what they want in their own fest, but people are allowed to express their concern if they feel there is unfair treatment in accordance with the rules the mods decided on.

Also, it's not like running a fest is something every person has time for. Most people who do Yuletide just want to write a fic, not start a fest, make the rules, go through nominations, assign pairs, send out pinch hits, etc. Saying that someone has no right to complain unless they start their own fest to remedy the complaint is like saying someone can't criticize a book until they're a published author. Obviously publishing a novel is harder than starting a fest, but both take more work than what the person set out to do in the first place. The mods can do what they want, and participants can criticize if they want.
